At John Galt Solutions we care deeply about privacy and believe in transparency. We are committed to being upfront about our privacy practices, including how we use your personal information.   This privacy policy tells you about the information we collect from you when you use our website and applications. We will refer to the site, applications, payment systems and our other services as the “Services”. This policy does not apply to the practices of third parties who may also collect or receive data in connection with your use of the Services.

Note that this Privacy Notice does not cover personal data that we may process on behalf of our clients or customers who use our Services. If an organization uses our Services and you have questions regarding the personal data held, please contact that organization in the first instance. We cannot erase your personal data or provide you with details of the personal data held about you in our Services without an instruction to do so from our customer so please contact them in the first instance.

2: How we use your information

2.1 - When do we collect data?

John Galt will collect certain personal data directly from you at the point at which you interact with us and/or use our Services. John Galt Solutions also collects information about how you use our Services and the device(s) you use to access these services. This includes collecting unique online identifiers such as IP addresses, which are numbers that can uniquely identify a specific computer or other network device on the internet.

2.2 - What data we collect?

John Galt may collect personal information relating to users of the Atlas Planning system, including:

  • First name;
  • Last name;
  • Address;
  • Job Title;
  • Company Name;
  • Email address;
  • Telephone number; and
  • Country

2.3 - What do we use it for?

We use your data in order to provide you with the information that you have requested, to respond to the request you have submitted or to contact you in relation to our Services. We may also use the personal data to contact you about the Services in which you have shown an interest or to send you other similar marketing materials. Our basis for using your data in this way is that it is necessary for the purposes of our legitimate interest of running our business and increasing our customer base.

Where you have indicated your consent to it, we may also use your data to send you other online resources or marketing materials which we believe may be of interest to you. Our basis for using your data in this way is consent. You can unsubscribe from our emails at any time using the “unsubscribe” button at the bottom of the email. If you are an EU resident, please see the section “I am a European citizen, what are my rights under GDPR?” below, for further information on how you can withdraw your consent.

We use the IP addresses and device identifiers we collect through our cookies to identify the location of users, for example to deliver a personalized service, block unacceptable use, etc. and for analysis and research purposes so that we may improve the services offered by John Galt Solutions. Our basis for using Your data in this way is that it is necessary for the purposes of our legitimate interest of improving our Services.

2.4 - What cookies are used?

When you use our Services, a number of cookies are used by us and by third parties to allow the website to function, to collect useful information about visitors and to help to make your user experience better.

Some of the cookies we use are essential for our website to function, and we do not ask for your consent to place these on your computer. However, as for the cookies that are useful but not strictly necessary, we will always ask for your consent.

There are also times where our Services are integrated with a third-party provider that utilizes cookies. These cookies do not collect information that identifies you. All of the information on these cookies is aggregated and therefore anonymous and relates to the functionality of the Services.

2.5 - What happens when you submit a query on our website?

When you submit an enquiry via our website, we ask you for your name, contact telephone number and email address.

We use this information to respond to your query, including providing you with any requested information about our Services. We may also email you several times after your inquiry in order to follow up on your interest and ensure that we have answered it to your satisfaction. We will do this based on our legitimate interest in providing accurate information prior to a sale.

Your query is stored and processed as an email which is hosted by Microsoft. It is also logged on a CRM system that is cloud based that has adequate data protection in place to protect your data.

We do not use the information you provide to make any automated decisions that might affect you. We keep query emails for two years, after which they are securely archived and kept for seven years, when we delete them. CRM records are kept for three years after the last contact with you.

2.6 - Who do we share the personal data with?

We use a third-party company to support our search engine optimization, website performance, hosting, maintenance and this party may have limited access to the personal data you submit through our website as a result.

We also use a third-party automated email provider to send out marketing communications on our behalf. We use a third-party CRM software to manage our customer’s experience. These companies are contractually committed to providing appropriate safeguards for your personal data which means it will be protected in line with the legal requirements of the United States as well as the European Union.

All third-parties with whom we share your data are required to protect it in accordance with applicable data protection law and, where the third party is acting as our data processor, they may only use it for specified purposes and in accordance with our instructions.

2.7 - What do you collect during a purchase of Services?

When you purchase Services from us online, we ask you for your name, address, contact telephone number, email address and credit card information. We also record your IP address, which is the address of your computer on the Internet.

We will use your information to verify your credit card details for your purchase, process your license purchase and send you the relevant information. We will also send you a receipt via email and we may use your telephone number to contact you regarding your purchase.

We require this information in order to process your payment, deliver your products or services and fulfil our contract with you. We record your IP address in order to show that the correct tax was applied to the sale, which we are required to do by law.

Your information is stored on our website and on our cloud server. Your credit card details are passed to a third-party payment processor which is based in the USA and provides adequate protection of personal data based on laws and regulations. We do not retain your credit card information.

We do not use the information you provide to make any automated decisions that might affect you.

We keep your order information for an indefinite period, in order for us to fulfil our licensing of our Services.

 

2.8 - What happens when I sign up for a newsletter or marketing materials?

When you sign up to receive our newsletter, we ask for your name and your email address.

We will ask for your consent to use your name and email address to email you our newsletter which contains information about our Services and other information which we feel might be of interest to you.

You can withdraw your consent at any time, and we will stop sending you the newsletter.

Your name and email address are shared with a third-party mailing system which is based in the United States. This company has contractually committed to providing appropriate safeguards for your personal data which means it will be protected in line with the legal requirements of the United States as well as the European Union.

We do not use the information you provide to make any automated decisions that might affect you.

We keep your personal data for as long as we produce and distribute our newsletter. If you withdraw your consent, we will mark your details so that they are not used and delete them after two years.

 

2.9 - I am a European citizen, what are my rights under GDPR?

right to request access – you may obtain confirmation from us as to whether or not your data is being processed and, where that is the case, access to your data.

right to rectification – you have the right to obtain rectification of inaccurate personal data we hold concerning you.

right to erasure – you have the right to obtain the erasure of your data without undue delay in certain circumstances.

right to restriction of processing or to object to processing – you may require us to restrict the processing we carry out on your data in certain circumstances or to object to us processing Your data.

right to data portability – you have the right to receive your data in a structured, commonly used and machine-readable format.

right to withdraw consent – where you have provided your consent to us processing your data, you have the right to withdraw your consent at any time. This can be done by emailing privacy@johngalt.com at any time.

right to lodge a complaint – you may lodge a complaint with the supervisory authority in the EU Member State where you are resident or where you work.

2.10 - Legal Compliance

We reserve the right in our sole discretion to disclose information about you without notice, including personally identifiable information, if it is necessary or appropriate to comply with applicable law, respond to legal claims and the legal process (including subpoenas), protect our rights, interests, or property, or if we believe in good faith that it is necessary to protect the personal safety of any person, including but not limited to: your safety, the safety of other users or employees, the safety of the public, or the safety of any third party.
